This policy is designed to provide information in regard to the subject matter covered, and with the understanding that the Director of Liquor Licensing is not passing legal opinion or interpretation or other professional advice. The information is provided on the understanding that all persons undertake responsibility for assessing the relevance and accuracy of its contents.
Under the Liquor Control Act 1988 (‘the Act’), the sale and supply of liquor must always take place on or from the licensed premises.
However, for producers, wholesalers and some special facility licences, section 4(6) of the Act provides that the Director of Liquor Licensing may approve premises other than the licensed premises for the purposes of storing liquor; and supplying or delivering liquor from those premises.
Producers may accept orders at a place other than the licensed premises (for example an office) if the sale is made online or by telephone. The dispatch of such an order must be made from the licensed premises or an approved off-site storage facility.
This policy provides guidance on lodging an application under section 4(6) of the Act for approval of an off-site storage facility.
If applying for the grant of a liquor licence, approval under section 4(6) of the Act for an off-site storage facility can be sought using the same application form. However, if off-site storage approval has previously been given and the licensee wishes to change the storage location, an application to add, vary or cancel a condition of licence must be lodged.
It should be noted that given the nature of the business under the different licence types, approvals under section 4(6) are generally only granted to wholesalers, producers and some special facility licences. In this regard, this type of approval will be considered for auction and online wine sales special facility licences.
If an application for an off-site storage facility is approved, the following condition will be imposed on the licence:
“Pursuant to section 4(6) of the Act, approval is granted to the licensee to store liquor at ... situated at ... and to supply and deliver from the stock of liquor kept on those premises, liquor sold on the licensed premises.”
